My state opened dispensary’s and outlawed home growers….
Does the farm lobby prevent anyone from growing vegetable or the tobacco lobby from people growing their own tobacco?
That sounds terrible.
Your going to have agencies like the dea and atf overlook cannabis farms. They’re not doing anything with fruits and vegetables farms. Not a realistic comparison
I’m also pretty sure tobacco has regulations on what you can do at home
We can talk about this stuff without getting heated…
That’s awesome. I have watched some conversation devolve unfortunately.
Go ahead and trust the feds, I personally DO NOT. Especially when there’s tons of money involved.
One of the reasons I want to get into the legal market under the state is it’ll be harder to do under federal regulations without being grandfathered. You can see this in the hemp program under federal regulations versus state
Home grows will be said to feed the black market as it has been said to contribute to it already.
Stomping out the balck market is the latest thing, millions if not billions is being spent to eliminate the balck market.
They already label home grows a danger to the public.
- Home grow will make it impossible for the state to eliminate the black market – most states that do allow homegrow place a restriction of six plants for adults. This limitation does not bode well for any commercial enterprise.
- Homegrow will make it impossible for law enforcement to distinguish between legal and illegal products – counting up to six plants should be enough for even a novice law enforcement officer to know they are not dealing with a hardened drug dealer.
- Home grow will undermine the state’s harm reduction goal of ensuring that cannabis sold in New York State is grown without noxious pesticides or other contaminants – if a person can grow tomatoes and peas in their garden without pesticides and contaminants, chances are they can do just as well with cannabis.
- Home grow will undermine the state’s public health interest in ensuring that cannabis sold in New York State is tested, packaged, and labeled correctly – since the person growing is also the one consuming, they know exactly what is being ingested from its infancy.
- Homegrow will cost the state tax revenue, thus hindering the state’s ability to fund priorities such as drug abuse treatment and community investment – homebrews have done little to affect the revenues of giant beer manufacturers and instead have spurred a growth in the craft beer industry. The same can be expected of homegrow.
Not trusting the Feds is one thing
Making asinine claims like they’re gona kick down my door to arrest me for something FEDERALLY LEGALIZED, is a whole other thing
You guys are grasping at straws with that IMO. Even the guy who said homegrows were illegalized and dispos were legalized, that’s STATE regulation not FEDERAL. Sorry your state blows
I don’t think anyone is saying they trust the feds. I just think there’s a disagreement on what they will and won’t go after.
And of course, once Cuomo got the letter, he made sure to keep home growers out because he loves that backroom moolah!
Did I miss something? Cannabis (sorry, marihuana) didn’t become federally legal recently did it?
Hmmm?
They could kick down your door if they are so compelled.
Let us look at medical for a min.
What medicine are you allowed to manufacture at home?
The feds will not be allowing medical grows in home you will need to get your medicine at the pharmacy.
What is the penalty for making phama drugs in your house?
Would they kick in your door if they thought you were making other pharma drugs?
I think they would.
Then it will be said…Why do you need to grow your own, you can buy it on every street corner.
Look through this thread a bit better and you will find a few more reasons for not allowing home grows once federally legal.
USDA is in charge of hemp farms plus whatever local regulations.
This is the point at which I say time will tell what happens. You obviously have a different perspective than I do. I will say that I have grown for almost 30 years with the last 2 being legal.
The feds might not kick in your door. I think it’s more likely that you’ll end up in court for using a patented plant you have no right to. The rules will definitely change once federal legalization occurs. It will favor corporations, not you. If you do homegrow, you might have to buy seeds or clones each cycle that you can’t reproduce legally in seed or clone form. This is a standard practice for hemp farms already
I personally think it’ll be like prohibition, and now people make beer and wine at home all the time. Controlled by the fed boys, atf is involved, and people do it at home without issue.
The hemp does not get you high. The usda will also be included as you said
Was it possible to do home brewing and winemaking right after prohibition ended?
Good question, I’m not sure.
In 1979 home brew became legal. While that didn’t happen right after prohibition, the precedent has been set, imo.
I’m also not a lawyer or any type of legal scholar.
