IMO I wouldn’t sweat copyright infringement unless you plan to use these stickers for a profit, for example as a business logo. If you are just making stickers to give away, you can argue “fair use”. It takes money and time to sue for copyright infringement, something most artists don’t have a lot of. Now if that were Mickey Mouse, that might be another story as Disney has the money and time to pursue copyright infringement.
To be honest I never even thought about it until I saw @monkeyman post. I just pulled images from Google and created the pic. I would have thought more about it if this was for a company logo but it just never crossed my mind. Still not even sure if there is a copyright on the image, all it tells me is it may be, lol. I did send an email to the artist Monkeyman linked just to be safe, hopefully they just say go for it. The last thing I want is to cause an issue for Greyfox. Will see how the artist responds.
you should also tell the artist you are going to alter it and send the altered image
First I will see if they respond. They may just tell me to piss off. I did tell them in email it was going to be altered to a degree as I mentioned we wanted them to be sitting on a bench. Will see what they say, if they are cool I will send them completed pic.
I am sure you will get a good response, since many people choose to do the opposite and just use them without asking, I am sure they will appreciate your concern and upfront attitude, and will be more likely to be receptive to your inquiry.
One of the artists on airbrush.com went to Disneyland Florida, he painted a Mikey and Minnie mouse Tshirt for him and his wife. They were wearing it when they checked into the onsite hotel. They had only been in their room for 10 minutes before there was a knock on the door, the hotel manager and 2 policemen were standing there, they were told they would be arrested if they didn’t hand over the Tshirts and say where they got them from.
He told them he had painted them himself, and it was fan art, he had progression pictures on his phone of when he was painting them, which was the only thing that saved him from losing them.
He was told to pack them away in the case and not wear them on Disney property otherwise they would be experiencing the same problem all the time they were there and wearing them.
Well there goes that idea. Message from the artist.
"Hello,
Thank you for reaching out about this. That art piece was a commission years ago from someone I can no longer remember so I can’t give permission for the art to be used unfortunately. "
Thats a bummer, normally copyright stays with the artist.
I have been back to some of the sites I frequented where the info was, but only 1 of the four is still operating and I can’t find the info on it now.
When you are changing a pic, especially if it’s going into a collage or composite with other material in a bigger picture, then it’s usually not a problem, and from what I understood so long as it was 20% different in composition it would not infringe copyright, but these copyright issues are subjective and can be argued.
So I guess it all depends on how it’s viewed and how much it resembles the original piece for reference.
As the artist says he has no copyright interest and the owner of the piece is not traceable any longer, and you are changing the characters and overal composition of the piece, as well as it not being used for financial profit. I would say you have a fair use option.
My bad, just read “royalty free” , at least you can screen capture for some avatars …
Hi Barefrog, mine has no copyright at all as it has been modified , I was admin on a pirate software forum
and had this avatar:
one of our members was graphic designer and just transformed it, since then I am using it …
royalty-free and copyright-free are two separate animals, not to be confused with each other.
I think I’ll try and find the artist for my avatar. I lifted it off a generic 70’s art google search. I’d love to know that I’m okay to use it. I really like it. There was a lot of really cool art back in the late 60’s and 70’s.
Been a week thought I’d better stop in for a quick update.
Last 2 plants that took forever to show their parts both girls both from Rez.
