While it did originally say it included the seeds if the sourcing plant material was above 0.3% THC. They clarified it below and classified the seeds as hemp as they are under 0.3% THC in weight.
" The AIA amended the CSA’s regulatory controls over marihuana by amending its definition under the CSA. Prior to the AIA, marihuana was defined in 21 U.S.C. 802(16) as follows:
The term “marihuana” means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin. Such term does not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.
The AIA modified the foregoing definition by adding that the “term `marihuana’ does not include hemp, as defined in section 1639 o of Title 7.” 21 U.S.C. 802(16)(B). Furthermore, the AIA added a definition of “hemp” to 7 U.S.C. 1639 o, which reads as follows:
The term `hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.
Taken together, these two changes made by the AIA limit the definition of marihuana to only include cannabis or cannabis-derived material that contain more than 0.3% delta-9-tetrahydrocannabinol (also known as Δ9 -THC) on a dry weight basis. Thus, to fall within the current CSA definition of marihuana, cannabis and cannabis-derived material must both fall within the pre-AIA CSA definition of marihuana and contain more than 0.3 percent Δ9 -THC on a dry weight basis. Pursuant to the AIA, unless specifically controlled elsewhere under the CSA, any material previously controlled under Controlled Substance Code Number 7360 (marihuana) or under Controlled Substance Code Number 7350 (marihuana extract), that contains 0.3% or less of Δ9 -THC on a dry weight basis— i.e., “hemp” as that term defined under the AIA—is not controlled. Conversely, any such material that contains greater than 0.3% of Δ9 -THC on a dry weight basis remains controlled in schedule I."

@sober Not too long ago, even getting seeds in Brazil as mail used to be a problem. Nowadays, after some legal measures were taken, and exactly due to not having traces of THC, seeds are no longer a reason for persecution and or legal procedures, even though that does not prevent individuals from wanting and “trying” to claim some form of illegal activity could be inferred. Reasons why we do have to be extra careful round here. It feels as though we are still living in the previous century.

Keep in mind, the most recent edition of the farm bill, which was supposed to be adopted last year but was not (instead the 2018 farm bill is still temporarily in effect until Congress passes the next iteration), is expected to close that loophole. But until that gets adopted, seeds are (“possibly”, “it depends”) legal.

I’m interested but apprehensive to sign up. I’m itching to try my first “chuck” but, aside from being inexperienced, I only have a couple plant options that I would be able to use this on. I think a win by me might be a shame.
