When does a cutting become a “plant”(legally)?

how many hemp plants are you allowed to have?

while you might have to have a license for a ‘farm’, in my state, a home grow is not a farm unless you are selling it.

in the past, a root ball was considered a plant. even if you chopped them, the cops would count up the root balls.

Here is the law in MI. From the way I’m reading this it looks like you could have a bunch of cuts and it won’t count towards your plant count.

When it comes to home growers I believe the same rules apply to it.

They also used to (in a certain state) put total weight including container so if they found a couple seeds and stems in the bottom of a plastic pill bottle, that could be considered 5-7 grams etc which is significantly more than .001 grams weight. They would read it out in court to a jury as 5-7 grams instead of the actual weight. This is how they could get people over the felony limit of 28 grams at the time without having 28 grams of product. Gotta get those felony quotas and bust people for stems and seeds to protect the children. Imagine if they just busted you with a giant glass ball jar that you just finished with a few trichomes on the bottom.

Yes I believe thats correct. The loophole is grow 6 autos and 6 photos as long as the autos are harvested before the others begin to flower. Thats what alot here do

I know a guy who was busted that exact same way. Just the residue left over is all they needed, they didn’t not weigh the jar however. Same for residue in your pipe, and the pipe was also a paraphernalia charge. It was also trouble to get caught with seeds here as well. Even a high times magazine was also considered paraphernalia.

The cops are crooked there, and the lawyers should get fired. That’s bullshit! By any measure, but I am from a different country.
Odd a jury could not see that?

@Cybersmib If its Not a seed, it is a plant.
Some places would also consider the seed a plant (which id disagree with).

Id advise to look up this info in your local area as all places have different rules regarding cannabis.

Yeah it’s per State definition.

For example, in Illinois, cannabis is considered a “plant” once it’s 5 inches long, including all root mass. :see_no_evil:

Legalization of Cannabis was a curse on Colorado. It changed everything and not for the better. Now the natural medicine act makes it legal to manufacture, transport and possess DMT, Shrooms, Inogaine and Mescaline in their natural forms. So doing a straight to base extract of DMT from some Mimosa root bark is completely legal ! And you can give it to your friends ! Ha ha. Sorry off topic.

Here in Colorado the definition is… ) “Plant” means any cannabis plant in a cultivating medium which plant is more than four inches wide or four inches high or a flowering cannabis plant regardless of the plant’s size.

I’m far less worried about that, and much more worried about attention being drawn to my space due to a random incident that’s beyond my control

There was a newspaper story in my hometown about 10 years ago of a middle aged man & his wife being charged with a felony for growing personal amounts in their attic. It was discovered because their house had burned down (can’t remember the cause, IIRC it was unrelated to their grow) and there was enough evidence left in the rubble to get them busted.

I think about this story at least every few months and it always makes me shudder. The horror it must be to lose a home & personal belongings, only to have even worse problems come crashing down due to laws around growing a plant

That’s why I still try to keep my shit quiet, even after my state legalized home grow. I don’t want any attention and I definitely don’t want someone counting my plants

I also don’t expect police to care whether a cutting has roots or not. If a cop sees what they think is a plant it’s gonna be counted as a plant :man_shrugging:

It was just a bad joke about the amount of corruption of the police in US. Just look it up. What I mentioned actually happened to me though so I know for a fact. Plus the hundreds of thousands/millions of other people who suffered so the local governments could get more revenue by ticketing people who have cannabis and then incarcerating them for it and collecting federal money for every prisoner they house. It is incentivized to be this way.

on the flipside, seeds haven’t ever been illegal. i think people were getting busted with shag pounds, but the lawyer would insist they removed the seeds so teh weight would go down.

but, ya, sucks.
