When does a cutting become a “plant”(legally)?

Literal crumbs… flakes on the bottom of a jar or a box in the side crease.

ya, in some places but before the farm bill there were places where you could request that all debris, seeds, etc.was removed and reweighed.

maybe some places but not wv, fl, nc, or oh. those are the places i have intimate experience with but it was all decades ago. hell, they even weighed the whole pot, dirt and all, when they busted a friend growing in his attic. he was just starting some plants for putting them out in the spring and they weren’t very tall so they made it sound like he was growing pounds. yeah, pounds of dirt.

Yeah man in my neck of the woods deep south Bible belt I knew a guy completely screwed they weighed all plant material dry flower dirt… but the dummy had a warrant for controlled substance so not exactly wise to bring them to your front door haha. Common sense is never as common as you think

i forgot why rich got busted, but me and a friend were outside when the cops were there. we were on our way to grab the girls and put them out but they got there first. they were on the way out when his girl comes out screaming how they missed the plants in the attic. she tried to slam the screen foor and put her arm through the glass and almost died though when it cut an artery. a cop put on a tourniquet and saved her miserable arse. he did 18 months for that one i think.

Friend of mine was busted with seeds like 40 years ago (3 in floor boards of his car, must of missed the other couple of thousand) and charged him with conspiracy to manufacture.

I’d like to thank everyone for their contributions to this discussion. As I assumed there was no right answer as it depends on the jurisdiction. Again it is my position that it is either legal or not. I understand that the authorities having jurisdiction don’t want me contributing to the black market and cutting out the taxman. I don’t want any yahoos calling or stopping by after last call to see if I am willing to spot a nickel bag (assume an 1/8 youngins) till payday. So free the weed and lock up those who wish choose to cut an out the taxman.

This is my favorite resource for checking state laws. They’re usually pretty up to date for each state.

A number of states explicitly include cuttings with plant counts, usually once they are placed in medium to root.

in texas, of all places…where the brownie weight was crack level charges. imagine going to school at as 15 year old with brownies and then getting a federal/state minimum sentence. nuts

In 1968, a Canadian dealer friend was busted for weed. The charging document said he was “…in possession of seven flakes of a substance resembling marijuana.” I kid you not. I will never forget that particular wording. lol (1) The judge threw it out.
