man, just got an email saying they’re going to “adjust the payment” because the terminations didn’t work and i didn’t provide test results. i guess the otdr scans in pdf that i sent that looked pretty damned good to me weren’t good enough. well, time to lawyer up just as soon as i turn them in for waste, fraud, and abuse. damn, i did not want this to go this way. i may be able to hit up her boss and get something done. coming back three weeks after i sent test results and telling me the fiber didn’t work sounds fishy to me and hopefully will to this idiot’s boss.

it was a $3250 job. i invested $1550 in tools to do the job on my credit account. if i sue for legal fees it’s an investment as long as i pay monthly and don’t ruin the credit waiting on payment.

You would be better served in small claims court representing yourself. Then you won’t be out 11k in Lawyers and waiting a year for a partial resolution. ( Don’t play inside straight draws its 27 to 1 .)
no arbitration clause so i should be able to get legal fees.
i’m lucky and hit the inside straight about 60% of the time. i also always see the flop in hold 'em. i flopped four of a kind with deuces and beat a pair of aces in the hole once. he had three and i milked it.
Wouldn’t he have had a full house though,since there was two dueces on the board since you flopped quads?

It all depends on where you live, so research diligently.

i’m gonna start with filing the waste claim with the govt and ask patrick (the dhs employee) what happened and explain the situation to him and ask what i should do. i concede the terminations may have been faulty because i didn’t do a decibel loss test, just the otdr for reflection. that was billed as $300 and can be deducted. but when i hire someone to do something and they don’t finish the job, i don’t hire someone else and not pay the first tech, i tell them i won’t pay until the job is done correctly. had they told me three weeks ago it failed i would have returned and fixed it immediately. i would have fusion spliced it the second time and had no issues with testing. this person said she had to hire someone else to finish my job and that kind of ticked me off a little. didn’t even tell me it was bad, just hired someone to fix it, after trying to short me $260. yeah, right. sorry, i was counting on that money as xmas bonus. ticked off a tad still. need another bowl.
damn, amazing how things work out sometimes. after the reply i sent with the threat to report them for waste, fraud, and abuse, i got the adjustment they were talking about: the full 3250. i guess they agreed with me that it would have been better to just tell me if i made a mistake instead of hiring someone else to fix it and not pay me for the work i’ve done. too bad that complaint went out last night. karma.
Good to hear! Those disputes can be hard on folks doing the work. I have taken several losses, and I will never forget those .
Glad to hear it sorta worked out for you… I have a $50k property line on a client who is trying to stiff me, and by the time we get done in court, I will hopefully get half of that back…
damn, that hurts. i had a judgement for unpaid wages that i won. that and a dollar would buy a cup of coffee at a gas station. never did collect the 1800 and it ran out. they’re only good for 10 years in wv. i may have been able to pursue it but it would have cost me almost all of it.
