I believe that one might be a common misunderstanding.

From what I was told, the one farmer intentionally pollinated his crops, then played like he didn’t mean to.

I could be misinformed of course

You got some crazy laws on IP for plants in US. We in Europe are very lucky to be sanctioned from this madness :sweat_smile:

The biggest flaw with Phylos imo is that they used these tiny tiny data markers to say how cultivars where related. This is not how you would do a dna data marker comparison to actually detect genetic relationships. The type of markers Phylos used are meant to mark important parts of a trait and search through millions of samples to select plants with only these markers. It’s super cheap and they definitely over charged for the tests. :sweat_smile:

Another thing I’ve thought about in US. If I program a computer virus and I makes millions of it. And someone comes along and steal my virus and start to make money themselves. Can I sue them for IP theft? I mean the thing that is created is against the law, so can you sue for illegal stuff. I think this goes for cannabis aswell. If I develop a branch of cannabis while there is heavy prohibition. It would be common sense that I can’t sue people for IP theft of this illegal IP.

It was supposed to be sterile. Pretty sure it happened to more than one farm

Also how many old cuts would have been sent in if growers realized that dna could be extracted and plants that they had locked down for who knows how long, just became the property of phylos. No specific contract

Definitely a scam with the gene sequencing, really they might be able to create a clone from the DNA. On the upside they really haven’t made anything that looks or sounds any better than anything else on the market. They way they were talking they should have the best plants on earth, clearly not I noticed they were selling seeds a few months ago and nobody has been talking about them.

I almost want to grab some just to chuck pollen on them and steal the genetics right back. Lol, if they come out with something actually worth while anyways, anything really good will probably end up a triploid cause they know I don’t give a fuck about their property. Lol

You have a very good point.
You probably can not win federally anyhow.
But if you are hit with a lawsuit and have the option to settle out of court vs a long drawn out expensive legal battle most would take the cheaper option.
Then we have a possible upcoming Federal legalization that will open the floodgates for these sorta lawsuits.
And with big AG and the likes Pfizer joining the cannabis game they will have lawyers getting paid good money sitting around doing nothing, they will happily send them to court and they know how to milk ya of your money.

So are plant patents really enforceable?
Some say yes, some say no, I say not yet but soon.

Sounds like it’s only illegal to make fems or clones of a patented plant, but you can cross whatever you want and backcross a few times if you like. Not too worried though I’ve been growing weed illegally since I was 13 and I’m almost 40, well I’m legal now, just moved to a recreational state.

@bluntmassa your not allowed to breed with it either. Very common in the hemp industry already.

I think that every current corporate entity in cannabis is terrified of federal legalization. Once Philip Morse and these types of corporate giants enter, it’s a whole new reality

Yep Oregon CBD aka GTR seeds always makes Farmers sign contracts and they’ve got all kinds of patents. One cool thing is though they’re research on triploids has been published. They probably own the patent on triploid cannabis too though funny not funny.

Wait a sec, ilgm are scammers??

Its gotta come down to the number of similar genetic markers or something, right? But then, being able to home grow your own, you could pretty easily (over a few years) breed out enough markers on your own… Interesting idea, which means it’s usually one that’ll cost a ton in lawyer fees :person_facepalming:

Never going to happen, Robert Clarke wrote about triploids in Marijuana Botany back in the 80’s. Then you have Humboldt Seed Company making some and I heard about others. Breeder Steve from Spice Of Life seeds actually talked about making sterile plants for breeders a while back, probably triploids.

Breeder Steve not only talked about it, he did it and made a whole company around it.

The phylos terms for those seeds is ridiculous.

Not ILGM, but how Phylos scammed everyone into giving them genetics for free. Dead material saying they couldn’t do anything with it, yet here we are in 2024 talking about bringing back mammoths from dead material. Lol, Claimed they won’t be trying to breed anything, then once they got enough material, they came out saying they were going to breed better weed than anyone else.

They definitely aren’t there yet, but if they do get their they will probably be the only ones that are allowed to breed with genetic markers.
