Legalization in NY this year?

If you want to give up the “priviledge” of gun ownership, and possibly allow someone into your house at any given time to make sure you don’t have more than a 6-month Supply of weed stashed away, or be pulled over by a cop at any moment so they can make sure you are not driving stoned. Very intrusive and counter to our Constitution…like it or not.
So I’m looking at June of 2024, which is 18 months after December of 2022 before I can plant any weed legally. Over three more years. Unbelievable. Am I surprised? Hell no. I’ve lived in this stupid state for too long to be surprised. And Cuomo says a million and a half New Yorkers have left in the last 4 years because of the weather ! What a liar! What a Jack Ass! I’ve been telling people he’s a liar for years now. Finally some people are starting to believe me. He is nothing more than a legal mob boss.

If I seem bitter it’s because my patience has worn out after a quarter-century of waiting. 25 years this year since California passed proposition 215. I thought 20 years ago I would be growing weed legally. Yet here we are

Well, I’m newer to the world of weed than you are by quite a lot (came to it late about 3 yrs ago in my mid-40’s), but it has become indispensable to my well-being, and I am equally chaffed by 'lil Andy’s bullshit - legal mob boss indeed.

His days are numbered - He has lost a big chunk of his base, his fuck-ups are accumulating, and I can’t see him re-ingratiating himself to enough NYers to get re-elected.

I’ll bet you the NYC mayoral election will be thematized by anti-Cuomo rhetoric, and whoever performs that the best will win.

I suppose we will carry on as usual, as we must until someone finally turns on the damn lights in this state, pun intended.

Wait. Those are requirements for a NY med card ??!!
Do you think they will change once its legalized ? Like why would they have requirements if any and everyone is free to have it ? I wish I could find the actual bill online so I can know what to expect !
All I have to go in is news article’s online. And to get the entire picture I had to read articles on 10 different websites and piece it all together because no one site had all the info ! Its frekin crazy.

They are adding more conditions to the list eligible for med in NY. Even better, the list will now says “…or any other condition certified by the medical practitioner.” That means that a doctor can give you a card for any condition they ‘believe’ will be helped by cannabis.

Approved by NY State Assembly and the State Senate. Just needs the governor’s signature now and he has said he will sign.

It is going to be interesting to find out what home growing means for people in NYC who mainly live in rentals or Coops/Condos that have their own rules. Also, it is possible that counties will get the final say on outdoor home grows (I need to read the bill to find out how that works). In California, some counties have prohibited outdoor home growing.

I want to know what the penalties will be for violating plant limits, since there is no way I’m only flowering three plants at a time.

It seems like a pretty good law overall. Many flaws, but better than what most other states in the North East have passed.

Penalties will be stiffer than they are now. Far from ending the War on Drugs, as I knew it would, this legislation is kicking it up a notch. Instead of facing jail time you will be facing losing your home or massive fines or both. Mark my words. Cuomo cares nothing for the plant or the people who use it. He cares about his rich friends and he wants to make them richer. I always knew it would be like this. No shock here. I was shocked when I thought we were allowed to grow 12 plants. Three plants seems more in line with greed. Did they even figure in for male plants? Fucking idiots

I read 3 plants in flower per adult. So you can have 6 plants in flower at a time if you have 2 adults in your household and 6 in veg (12 plants total). It’s the same as CO. I don’t know if there are actually better laws anywhere in the country. Still bullshit, but if you were hoping they were gonna do more, nobody is.

Does it say anything about people who are caregivers ? Or any info on people who have med cards ?

@Upstate Also if you’re counting by lefthand arithmetic, male plants don’t produce resin and therefore qualify as hemp and do not count.

Yes on both. There is a lot there; the bill is 128 pages. So you will need to do your own research or find a good summery, but here is a key part.

19 § 41. Home cultivation of medical cannabis. Certified patients twen-

20 ty-one years of age or older may cultivate cannabis for personal use.

21 Designated caregivers twenty-one years of age or older, caring for

22 certified patients either younger than twenty-one years of age or whose

23 physical or cognitive impairments prevent them from cultivating canna-

24 bis, may cultivate cannabis for use by such patients, provided that no

25 other caregiver is growing for said patient or patients. All culti-

26 vation under this section shall be in accordance with section 222.15 of

27 the penal law and any regulations made by the board, provided that the

28 maximum number of cannabis plants a designated caregiver is authorized

29 to grow is proportionately increased for each patient they are growing for.

Medical cannabis, certified patients, and designated caregiver are terms that have specific legal meaning that is defined in the law.

This part is really interesting to me… there will be licenses for “Microbusiness.”

40 § 73. Microbusiness license. 1. A microbusiness license shall author-

41 ize the limited cultivation, processing, distribution, delivery, and

42 dispensing of their own adult-use cannabis and cannabis products.

43 2. A microbusiness licensee may not hold any direct or indirect inter-

44 est in any other license in this chapter and may only distribute its own

45 cannabis and cannabis products to dispensaries.

46 3. The size, scope and eligibility criteria of a microbusiness shall

47 be determined in regulation by the board in consultation with the execu-

48 tive director and the chief equity officer. The granting of such

49 licenses shall promote social and economic equity applicants as provided

50 for in this chapter.

We have to wait until the Control Board writes the rules for this and it may only be open to equity applicants, but it seems to pave the way for small farmers to legally grow and sell direct to the public.

I’m starting to regret that I’m moving to California (for my non-cannabis day job) at the end of this year.

Looks like New York might be following the Massachusetts model. There are 10 tiers for Licensing in Massachusetts, with Tier 1 and 2 being craft size businesses of 5000, or 10000 sq ft. Canopy size. Has anyone found the part where they tell you how much it costs to apply and or get a license? In Massachusetts it was $3,000 to apply, and if you got your application approved it was an additional fifteen thousand a year for the license.

So my buddy tells me yesterday that effective immediately we can grow at home. I have yet to confirm this. Has anyone else seen this?

Virginia is allowing home cultivation of 2 plants in flower and 2 in veg per household, not per adult. They are allowing home cultivation effective July 1 with legalization to help thwart the increase in free market sales. Not sure how fast they think these plants grow…lol

Dispensaries will not open until 2024. Existing medical dispensaries are not allowed to sell recreational. Guess some Virginians will be taking a lot of trips to legal states for a while…lol
